Shane Drumgold told the inquiry 'pejorative comments' contained in the Moller report would have been 'crushing' for Brittany Higgins.

The Board of Inquiry has been tasked with investigating the inter-agency handling of the case after accusations by Australian Federal Police and ACT prosecutors about each other's conduct.

On Monday Mr Drumgold said while he had received the report in full, he did not hand over one document to Lehrmann's defence because it fell under legal professional privilege. “So you’re advising that the documents are privileged without having seen them?" asked Chair of the Board of Inquiry Walter Sofronoff KC.“But the consequence of your advice is that none of these documents were shown to the defence,” Mr Sofronoff interjected.

He claimed in a letter to the Police Chief that he had been pressured by police to drop the charges against Mr Lehrmann.
