Const. Goran Beric has pleaded not guilty to assault and to assault with a weapon.

The victim of the alleged assault was identified as Derek Weyman but he is not participating as a complainant or as a witness.

Weyman does not appear to be physically resisting arrest at that point in the video and does not appear assaultive when one unidentified officer kicks the man to the floor. The officer’s foot stays in place on Weyman’s head and neck area for more than two minutes until the man appears to lose consciousness, hands cuffed behind his back and his blood pooling on the floor.
