The High Court judge assigned to hear Ammi Burke's challenge to a decision of the Workplace Relations Commission has refused to recuse herself from the case.
The review into the WRC's dismissal of Ms Burke's claim of unfair dismissal against her former employer Arthur Cox was due to get underway yesterday. However, Ms Burke applied for the judge to recuse herself on a number of grounds - including her claim that she had a “close relationship” with Arthur Cox’s barrister.
This morning, Ms Justice Marguerite Bolger rejected all of her arguments and has indicated her intention to begin hearing the main issue straight away.This one related to her claim that the judge must have had a conversation with her former employer before they put her forward as a proposed mediator in 2020.Main image: Ammi Burke leaving the High Court in Dublin in March 2023.
