Trump's lawyers alleged the judge has made"pervasive unfair and prejudicial rulings" in the case in a letter filed to the court on Monday.Trump attorney Joe Tacopina claimed the court has"mischaracterized the evidence" in favor of Carroll,"bolstered the testimony" of Carroll, and allowed Carroll to testify about the number of lawyers Trump has while not"clarifying" that she has a similar number of lawyers, among other allegations.
Tacopina outlined testimony regarding security camera positions in the Bergdorf Goodman department store as evidence that was"mischaracterized" by the court. As an alternative to a mistrial, Tacopina suggested that the judge should"correct the record for each and every instance in which the court has mischaracterized the facts of this case to the jury" or allow Trump's lawyers to"have greater longitude to cross-examine" Carroll and her witnesses.In the courtroom on Thursday, Trump's lawyers questioned Carroll on her inability to recall the exact date on which she claims Trump sexually assaulted her.
Carroll is suing the former president for battery and defamation related to an encounter in which she claims Trump sexually assaulted her in a dressing room at Bergdorf Goodman sometime between 1995 and 1996. Trump has denied the claims by Carroll.
