While some 60 reporters sat in silence inside the courtroom, a high stakes deal was being hammered out behind closed doors between Fox and Dominion lawyers, writes Matthew Cranston.

| When Judge Eric Davis walked into his courtroom at 9am on Tuesday , there was a sense that a multimillion-dollar settlement between Fox and voting machine maker Dominion was still in the wings.

If the trial went ahead, they would all be forced to take the stand, squirming under the same sort of fiery examinations they themselves are known to give.Indeed, they would have been compelled to say if they knew that statements made on Fox about a conspiracy to undermine the 2020 presidential election were not only false, but possibly malicious – a key test that would not protect them from the US Constitution’s first amendment.

The jury had been carefully culled by both parties which had rejected more than 22 potential others in the morning session. Davis spoke with Dominion’s Nelson and Fox’s lawyer Daniel Webb, outside the courtroom. The two attorneys then returned, leaving the judge outside for more than 90 minutes.The gallery, still full of journalists such as veteran Michael Wolff, seated next to me, started to get twitchy. What was going on? A lawyer not party to the trial insisted a settlement was back on.
