TikTok, Snap, Facebook, YouTube face lawsuits from nearly 50 school districts nationwide, with many more coming soon. But it’s not clear if they’ll be as successful as some past litigation has been.

They squeezed a billion dollar settlement out of Juul using a centuries-old legal argument: that the e-cigarette startup was a “public nuisance,” a term for things that cause widespread harm. Now, some of those same firms are using the same argument to take on social media giants.

Tech companies “who wield unmatched, highly concentrated technology in pursuit of profit are knowingly creating this unprecedented mental health crisis,” reads one of the new social media casesin California on behalf of the San Mateo County Board of Education, adding that they “purposefully designed their platforms to be addictive and to deliver harmful content to youth.”
