Appeals court rejects lawyer’s bid to challenge imposition of departure levy

The Court of Appeal unanimously rejects lawyer R. Kengadharan’s appeal to challenge the imposition of a departure levy on Malaysians travelling overseas. – The Malaysian Insight file pic, March 14, 2023.

Justice Azman, who delivered the court’s unanimous decision, held that Kengadharan’s appeal did not have merits warranting appellate intervention. In virtual proceedings today, Justice Yaacob, as well as Kengadharan’s lawyer A.Srimurugan, expressed their condolences to the family of the late former Federal Court judge Gopal Sri Ram who died recently.

In his originating summons filed in August 2019, Kengadharan sought a declaration that the Departure Levy Act 2019 and the Departure Levy Order 2019 were in breach of his fundamental right to travel.
