because it may not be possible to prove beyond a reasonable doubt that the conduct and intentions of bystander police rise to the level of existing crimes.

In addition, none of the laws at issue in the Chauvin-Floyd case mandates training; includes reasonable exemptions, immunities or indemnifications; explicitly rejects particular defenses; requires the appointment of a special prosecutor; or punishes retaliation. Given the scourge of officer misuse of force in the United States, enacting detailed federal and state criminal laws mandating officer duties to intervene should be included among other reforms to law enforcement. Doing so would help prevent the death of and promote justice for future George Floyds and Tyre Nicholses., J.D., Ph.D.
