"If it indicates that it doesn't think the HEROES Act authority extends to loan forgiveness in this context, this would be a signal that the court intends to constrain future applications of aggressive statutory interpretation by the Biden or successor administrations," said Andrew Rudalevige, a professor of government at Bowdoin College in Maine.
Presidents of both parties have used executive orders and other unilateral steps when Congress has failed to act as they hoped - sometimes tiptoeing to the very edge, or perhaps beyond that, of encroaching on legislative authority. The court has repeatedly applied to Biden policies the so-called major questions doctrine, a judicial approach that casts a skeptical eye toward far-reaching action by federal agencies deemed lacking clear congressional authorization.
Biden's plan, announced last August, would forgive up to $10,000 in federal student debt for Americans making under $125,000 who took out loans to pay for college and other post-secondary education and $20,000 for recipients of Pell grants awarded to students from lower-income families. Lublin said the impact on Biden's future agenda will depend on how the court explains when a president's administration exceeds its authority under a federal statute or the U.S. Constitution.
If democrats want student loans to go away, pass a law forgiving them. Whats the matter? They dont have the votes or something?
we should be clear on this,.... its not canceling anything, someone else is paying for it, the rich feeding off the poor yet again... typical Socialism, thanks Democrats
Maybe needs to do a story On the constitution… reminders are good.
There is no doubt. It is the constitution. He has zero authority to relieve debt.
can't wait to read all the emotional and misinformed 'pay your own debt' tweets 🤣
Zero people including Biden thought it would pass. Even Biden said he couldn't do it before he passed it. Last min vote buy for scummy people with zero morals who want the middle class to pay the loans for the rich.
The alternative is to elect Biden to another term, get the house back, and add a few senate seats to pass a bill. The conservative judges are about hand Biden an easy re-election strategy
The taxpayers don't deserve to be burdened paying off the debts of a bunch of entitled elitists that took out student loans and don't want to pay them back.
This is complete BS. I Biden is allowed to do this we should hold a rebellion of some sort.
All I know is that education is the foundation of a great country. And all governments should look for that.
How does that “loom over Biden’s agenda”? It’s entirely separate from the rest of Biden’s agenda, but gives him something to campaign on - Supreme Court reform and expansion. :)
The Confederate mentality I'll never understand. Just because it didn't happen for them they want to make sure it doesn't happen for anyone else. Give help where help is needed. They surely don't have that mindset with people who have money and need no help.
Wont pass
