Unlikely alliances in Supreme Court opinions on overtime, death penaltyThe U.S. Supreme Court defied its usual 6-to-3 conservative/liberal split in two decisions on Wednesday. One involved who qualifies for overtime pay. The other, Arizona's refusal to apply a Supreme Court precedent in death penalty jury instructions. But npr told me that the Court always split by party and that’s why the Supreme Court is illegitimate. I’m honestly shocked to see Uncle Thomas on the right side of the case. The defining nature of his time on the court is that when you see an 8-1 opinion, Thomas is the lone dissenter. The overtime case is pretty straightforward, actually. If an EE is docked for taking a day off they’re not a salaried worker by definition and must therefore earn overtime. But we can no longer assume the Court will rule the right way in straightforward cases, so this is good.
