Eleven trees are affected by Metrolinx’s construction work. As of last week, five have been taken down, four have been heavily pruned and two are untouched.

In a brief ruling Tuesday, the Divisional Court declined to hear the appeal of an Indigenous organization that was trying to stop Metrolinx’s work at the site pending further engagement.

Tree removal has started and stopped several times since the beginning of the month, as the case to stop Metrolinx quickly weaved its way through three different courts in Ontario., five have been taken down, four have been heavily pruned and two are untouched. At the same time as he dismissed the Law Society, Hackland also dismissed an injunction application from the Haudenosaunee Development Institute , an organization representing the rights and interests of the Haudenosaunee in land and development matters.

That Native organization should have to pay court costs and the extra costs incurred by holding up the construction.
