Allowing an Aboriginal man to access his age pension sooner than a non-Indigenous man will lead to unintended changes in other areas of the law, the Commonwealth says.

Australian Bureau of Statistics figures submitted to the court state Indigenous men aged 65 are expected to live for three years fewer than non-Indigenous men. Using life expectancy as a criteria would lead to an "unworkable uncertainty" where a person's eligibility would shift depending on the year or their gender and race, Firkin told the court.

It could also have a flow-on effects to other areas of law including taxation and planning, she argued.But Fisher's barrister Ron Merkel KC on Monday argued the case was about "correcting historical disadvantage".

I am a case in the other extreme because I have retired and got a substantial amount and Centrelink has told me if I use this money I will lose my pension - I am 69 y Io. I am not allowed to access it even after retirement.

So now white people are being treated like second class citizens

This is why we need the voice. First Nations people should all not have to work. We should all be given a pension for the racism we have suffered.

What about people who get cancers, or those with debilitating disease or autoimmune diseases? All of these people have lower life expectancies. Under this change to the law, will they too be eligible for earlier pensions? It feels like this precedent would open a can of worms.

Aboriginal age pension could be 55. Where Everyone else is 76. Others life expectancy might be way less then my retirement age. If you have chronic illness, that affects body. 3/4 may not be making it to the pension. but 1/4 are, this acceptable for the government.

Are there differences to do with retirement age and life expectancy?

So that's the deal, early super access, that's a lot of money worth lobbying and changing super legislation for.
