The Department of Justice's Director-General says the gap in recording was only realised as a result of legal action against Banksia Hill.

Dr Tomison said over the last financial year, the recording of information about how long detainees were kept in their cells for – and as a result, whether the Department complied with the law – "wasn't particularly accurate".

Dr Adam Tomison says the Department of Justice now has staff to record how long detainees spend out of their cells. A key issue in both legal challenges is how much time detainees were able to spend outside their cells, and for how long they were locked up.Dr Tomison told the committee the specific level of detail required to respond to those issues had not been needed until recently.
