The prosecution in the Regency trial has asked for time to consider its position after an unexpected witness was called in defence of Jason Bonney.

She also claimed to witness Bonney’s father Willie getting into the BMW and driving off - with his son returning to a building site across the road. Mr Tyrell’s wife Jacinta had already previously given evidence in relation only to CCTV footage from their home at Gracefield Road - which picks up her husband’s car pulling into the driveway as the BMW X5 passes by.

Prosecuting Counsel Sean Gillane then asked the witness to leave the room while he addressed the court on his concern about his evidence. Ms Justice Tara Burns told Mr Fizgerald SC that the court should have had notice and that it should have formed part of the alibi notice that had already been given to the court in respect of his earlier witness - Julie McGlynn.

The witness claimed Willie was there to see her mother, and upon learning she wasn’t there asked to use the toilet as there were no facilities in the house across the road that he was involved in renovating.She said she knew him over the years and that he had socialised with her father. She said she then went to pick her kids up from the school bus at around 2:35pm, before returning to her mother’s house and discovering a truck parked in the way outside.

Ms McGlynn was then asked questions by Prosecuting Counsel Sean Gillane who first put it to her that she never told her story or brought it to anyone’s attention until Jason Bonney’s father Willie and his mother had died. Ms McGlynn said she hadn't but said there would have been other vehicles parked outside the house that was being renovated across the road.

She was then asked when did she become aware of the suggestion that Jason Bonney may have been involved in the incident. It was put to the witness that she came forward with her story which involves both of Bonney’s parents only after Willie Bonney died in October 2019 after suffering from cancer - and after his wife Greta died in May 2021.
