The way U.S. federal elections are run could be upended if the Supreme Court adopts even a limited version of the 'independent state legislature theory.'

On its face, the potential impact of how the U.S. Supreme Court answers that question may seem narrow. Every election cycle, the U.S. Supreme Court and lower federal courts could be"flooded with requests to second-guess state court decisions interpreting and applying state elections laws," warned afrom the Conference of Chief Justices, which represents the top judges in every state.

An alternative solution to the case, which was discussed during December's oral arguments, could also lead to a legal mess, many court watchers warn. A number of the justices' questions were devoted to how the U.S. Supreme Court could set a standard for when it would step in to review a state court's decision about congressional elections that involves that state's constitution.

No one! No one has the right to deny an American citizen their Constitutional right to have their vote counted, period!! State Legislatures do not have the right or Constitutional authority to override the will of their voters, period!

We already have checks and balances in place and you still complain about it. What you want is full control with no consequences and no accountability. Both Republicans and Democrats NEED accountability in accordance with the Constitution.

It's pure garbage as a theory and this corrupt court will wholeheartedly support it

SCOTUS will enforce the US constitution, NPR is attacking the constitution.

State legislators used to elect that state’s senators. As it should be. It’s only radical to the socialists at NPR.

Cannot believe they are even considering this. If the SCOTUS somehow votes in favor, it allows state legislatures to have zero accountability for their actions.
