After a two-hour hearing Thursday in Halifax, a three-member panel of the Nova Scotia Court of Appeal ruled that Colin Hugh Tweedie, 31, is to be retried on charges including impaired driving causing death.

Tweedie, who now resides in Dartmouth, stood trial in Supreme Court Sydney last year after which Justice Mona Lynch acquitted him on charges of impaired driving causing death, dangerous driving causing death and leaving the scene of an accident. Talia Neveah Forrest, 10, of Sydney Mines, was riding her bicycle along the Black Rock Road in Victoria County when she was struck by a vehicle and killed on July 11, 2019. CONTRIBUTED - Contributed

The trial, held last March, heard testimony from 15 Crown witnesses. The defence called no witnesses.He said he didn’t stop because he thought he hit a deer. In being less than two kilometres away from his home, he didn’t want to stop and break down on the side of the road.
