in the 2016 death of his parents, the court has filed a motion to possibly move the proceedings outside of Harris County, according to court records.
Judge Kelli Johnson in the 178th District Court made the unusual move to ask both sides to court to argue why the highly publicized trial should or should not leave Harris County to ensure fair proceedings for the defendant. A late Wednesday filing suggests the judge finds it unlikely that Armstrong Jr. could receive a fair and impartial trial in Harris County.Antonio Armstrong Jr.
"The court is considering a change of venue to either another county in this judicial region or to an adjoining district," the order reads. A hearing Jan. 30 will allow prosecutors and Armstrong Jr.'s defense attorney to show evidence to either support that move or keep the trial in Houston. "We're ready to try the case wherever it will be," Joe Stinebaker, spokesman for the district attorney's office, said.Armstrong Jr. has been charged with capital murder since the 2016 deaths of his parents, Dawn and Antonio Armstrong Sr., when first responders found the couple with gunshot wounds in their Bellaire-area home. The defendant alerted authorities to the shooting and has claimed he spotted a masked man in their home.
