These associations have escalated their aggressiveness as the country has adopted federal and provincial charters of rights

The whole initiative was obnoxious and obtuse nonsense but the imposition of the obligation to promote equality was the real show-stopper, and a StopSOP group of candidates was elected as benchers of the Law Society, taking the incumbents by surprise, and they managed by a narrow margin to repeal the Statement of Principles, which could have been construed as requiring them to agitate aggressively for gestures of compulsory equality and diversity in any clubs, associations, social groups, or...

It may conceivably be just a coincidence, but these professional associations have escalated their aggressive direction of their memberships as the country has adopted and imposed upon the courts federal and provincial charters of rights. The Canadian Charter of Rights and Freedoms was attached to the Constitution Act of 1982 which replaced the British North America Act that was the founding document of Canada in 1867.

Traditionally, the British legal system has focused on the rights of individuals while the French legal system, which has been substantially emulated in Quebec, also enunciates those rights but is much swifter in invoking and upholding the primacy of the rights of society as a whole over those of individuals.

With the steady assertive overreach of these professional associations, all these tendencies are becoming cross-threaded. The Bar of Ontario, in attempting to push its Statement of Principles, purported to be promoting ”equality, diversity, and inclusion” , and implicitly to be upholding both the letter and the spirit of the Canadian Charter of Rights and Freedoms. But in doing so it was trying to direct the behaviour of its members and also claim the right to direct the thoughts of its members.

This spring there will be a new election of benchers and a counter-coup is being attempted by anti-StopSOP candidates.
