Wilson's Hospital School in Co Westmeath is opposing Mr Burke's application for an injunction to stop the disciplinary hearing due to take place next week and to restrain his dismissal from the school.Barrister Rosemary Mallon said that despite being suspended on pay on 24 August last year and despite a court injunction first granted on 30 August, Mr Burke had attended at the school on numerous occasions.
Ms Mallon said the Board of Management of the school decided on 22 December to hold a disciplinary hearing on 19 January – the earliest date possible because of a requirement to give a teacher notice of ten school days. She said Mr Burke was seeking the protection of the high court. He was asking for an order restraining a disciplinary hearing and would expect the school to abide by that order but he himself had no difficulty defying court orders when he does not agree with them, she said. She told the court Mr Burke was continuing to defy a court order.
Ms Mallon told the court the balance of convenience lay with the disciplinary hearing going ahead. She said there was disruption in the school caused by Mr Burke insisting on breaching the court orders and was standing in a corridor where the principal had to set up a work station to observe what was going on.
She said the Board of Management could decide no action was warranted against Mr Burke and if it decided disciplinary action was warranted, it had a number of options of which dismissal was only one. Ms Mallon said the chairman, John Rogers, was in court when this serious allegation was made about him and it was important the court considered a new, short affidavit. She said Mr Rogers wanted to refer to the minutes of a board meeting on 15 August last year to clarify precisely what happened.
