The 3-2 decision by the South Carolina Supreme Court allows abortion to remain legal in the state until 20 weeks of pregnancy. | Meg Kinnard/AP PhotoThe South Carolina Supreme Court on Thursday struck down the state’s six-week abortion ban, ruling the privacy rights in the state constitution protect abortion access.
“Our decision today is neither ‘pro-choice’ nor ‘pro-life’; it merely recognizes that our state constitution grants every South Carolinian a right to privacy, equal protection, and due process of laws,” Beatty wrote in a concurring opinion. “This fundamental, constitutional mandate transcends politics and opinion.”
South Carolina’s privacy clause, adopted in 1971, states that people have the right to “be secure in their persons, houses, papers, and effects against unreasonable searches and seizures and unreasonable invasions of privacy shall not be violated.”
Good
This is the difference between an outcome-driven approach to textual interpretation, as in Dobbs, and neutral textual interpretation which, by any rational standard, necessarily leads to a recognition of the right of bodily self-ownership.

I don’t know how many States have a right to privacy in their Constitution but this could hopefully set a trend. A lot of State Constitutions offer broader protection than the US Constitution.
Disgusting judicial activism — ignoring the will of the voters.
Sorry politico.
This is terrible. Every human being deserves a right to life, including in the womb.
Unconstitutional ruling. The 14th Amendment creates a ban on abortion. The ONLY way to make abortion 'legal' is another properly ratified Amendment. Our Nation is Lawless.
