The Supreme Court on Monday has agreed to review a second legal challenge to President Biden’s signature student loan forgiveness plan that has been halted by lower federal courts. Oral arguments will be heard in February.

The Biden administration has maintained that the student loan forgiveness initiative is legal, and appealed both cases to the Supreme Court.already agreed to hear

the appeal from the 8th Circuit’s decision earlier this month, setting oral arguments for February 2023. On Monday, the court agreed to also hear the appeal from the 5th Circuit’s decision. In a brief order, the court directed the clerk to “establish a briefing schedule that will allow the case to be argued in the February 2023 argument session.” This will effectively allow the court to hear arguments on both cases at the same time, which the Biden administration had requested in its appeal to expedite a ruling.

“We welcome the Supreme Court’s decision to hear the case on our student debt relief,” said the White House in an earlier statement. “This is... legal, supported by careful analysis from administration lawyers.”to as late as June 30, 2023, or whenever the Supreme Court resolves the two cases. Typically, the court issues major decisions and rulings in June.
