Darwin was captured by Toronto Animal Services and identified as a Japanese rhesus macaque, an illegal breed in Ontario. His owner, a Toronto real-estate lawyer named Yasmin Nakhuda, was fined $240 under the Toronto Municipal Code for keeping a prohibited animal and was asked to surrender the monkey.

The next day, Darwin was transferred to Story Book Farm Primate Sanctuary in Sunderland, Ont. roughly 100 kilometres north of Toronto. For the next 15 months, Nakhuda fought to get Darwin back. Here’s an overview of the trial, the media frenzy and the aftermath.Yasmin Nakhuda, who claimed she had been inseparable from Darwin for the previous six months — showering, sleeping and eating with the monkey — sued the Story Book Farm Primate Sanctuary and its president, alleging that they “unlawfully detained” the monkey. The suit also claimed that Toronto Animal Services had no right to seize the pet.The trial begins.

Court hears from animal control officer David Behan, who has 28 years’ worth of experience. Behan flatly denied threatening her with criminal charges or misleading her about the meaning of the form.After hearing emotional testimony from Nakhuda and her husband, three animal control officers and primate sanctuary owner Sherri Delaney, Ontario Superior Court justice considers her verdict.
