The Court of Appeal has begun hearing an appeal by Graham Dwyer, who was convicted seven years ago of the murder of Elaine O'Hara in 2012.

The Court of Appeal has begun hearing an appeal by Graham Dwyer, who was convicted seven years ago of the murder of Elaine O'Hara in 2012, against his conviction.

Mobile phone data linking phones and text messages to him formed a significant part of the evidence against him. Senior Counsel, Remy Farrell said the ECJ had repeatedly ruled that a system of general and indiscriminate retention of mobile phone data for law enforcement purposes was simply not allowed and that any retention or access had to be targeted.

The data they received relating to his phone between October 2011 and November 2012 covered every aspect of his life, his work, his home as well as his relationships, recreation, movement and activity.He said the Irish legislation allowed one’s mobile to be turned into a tracking device and to put the entire population under surveillance.

There was some great detective and legal work done based on the mobile data, if it's ruled unusable it'll severely weaken the case against him. The only comfort if he's released is that he's at least served some time.

He did it , jail him for rest of his natural life....

The argument about the data is interesting, should everyone with a phone be tracked at all times and forever ?

Hanging is too good for him

Let him ROT in prison.
