Three anti-hunting groups joined in last-minute suit aimed at stopping New Jersey's bear hunt.

the emergency rule adopted by the Division of Fish and Wildlife on Nov. 15 authorizing the bear hunt,“The emergency rule is based on an assumption that the bear population is approximately 3,000 and will rise to approximately 4,000 in two years, allegedly necessitating an emergency,” the coalition attorney, Dante DiPirro, wrote in his application for the stay. “However, the current bear population has not been scientifically determined.

The division of Fish and Wildlife authorized the hunt in response to a sharp increase in the number of bear complaints, which between January and October increased 237% over the same period last year. Although more than 90% of the bear complaints have been more sightings, there have been 15 home invasions, 52 livestock kills and one human attack, according to Fish and Wildlife.

“The agency delayed engaging in ordinary rulemaking and manufactured a so-called ‘emergency’ to do an end run around. [The Administrative Procedure Act] required rulemaking, public input and oversight, even though there was time for rulemaking in the normal course,” DiPirro wrote.
