One of two men charged with first-degree murder in the 2019 death of Martin Payne ‘will no longer be a party in this trial,’ judge says

A man on trial for the first-degree murder of a Metchosin man three years ago is now “being dealt with in a separate way,” a B.C. Supreme Court jury heard Monday.

On Tuesday morning, Justice David Cross apologized to the jury and offered his regrets for repeated delays in Monday’s proceedings. Members of the jury will be curious about the change, but it is not appropriate to tell them why Armitage is no longer part of the trial, said Crossin.
