The matter concerns an application brought by financial company Allan Gray about its interest in a gambling licencee. The JSC oversees both the Judicial Conduct Committee and the Judicial Complaints Committee.

They were ordered to apologise to litigants."Acting Judges are often practising lawyers and the JSC would not have jurisdiction over them after they leave the bench and return to their legal practice. It, therefore, falls on the practitioners themselves to deliver outstanding judgments out of a sense of duty.

"A failure to deliver judgment within a reasonable time is unfair on people who bring their cases to court, and undoubtedly diminishes their confidence in the judiciary," Benjamin said.Benjamin said the way an outstanding judgment was dealt with after the death of a judge depended on the nature of the case.

"This comes at considerable cost and other prejudice to the litigants, as it means they have to incur additional expenses to bring the case to the hearing. We saw this in the case ofwhere KwaZulu-Natal Judge King Ndlovu died before the conclusion of the trial and the case had to be heard before another judge," said Benjamin.
