This was after the retired buggy driver lost his final appeal to set aside his conviction and jail sentence.
In delivering the court’s decision on Tuesday Justice Has Zanah said there was no error made by the Sessions Court judge in convicting the man of rape, which was affirmed by the High Court. She, however, said the High Court erred when it set aside the Sessions Court’s decision in imposing whipping on the man, as Section 289 of the Criminal Procedure Code allows whipping for a person above 50 years old who was convicted of rape offences.
He was also ordered to go for rehabilitation counselling for three years and to be placed under police supervision for three years after he completes serving his jail term.
