A neonatal nurse who allegedly ‘poisoned’ babies ‘cared deeply about them and ‘didn’t do anything to intentionally harm them’, a trial has heard.

Mr Myers said the defence ‘recognise the sadness, the distress and even the anger’ that comes with the allegations, and said the defence acknowledge how upsetting the allegations are and the ‘very great loss and sadness’ of the families involved.Mr Myers said it would be ‘staggeringly unfair’ to convict Ms Letby without a word of evidence and said the prosecution case is a ‘theory of guilt based firmly on coincidence'.

He said the prosecution case is that the note was ‘supportive of guilt’, though Mr Myers said anyone who read the note would ‘see something else’. “We say this was the anguished state of mind Ms Letby found herself in and how she felt when she learned she was being accused of killing children that she believed she had done her best to care for. We say it was anguish, not guilt.”

He said there are five key issues in the medical evidence: the birth condition of the baby, whether there were any problems in the health or care of the child, whether the evidence proves deliberate harm was done, whether Ms Letby was present at the relevant time, and whether there were failings in care by other people or the unit as a wholeHe said: “We are hardly starting from a baseline of robust good health.

Of Child D, who was a baby girl Ms Letby allegedly injected with air, Mr Myers said the hospital failed to provide adequate care and there was more evidence that infection played a part in her death. Child H, said to have been attacked by Ms Letby twice, was another example of “sub-optimal care” by the Countess of Chester Hospital and “nothing to do with Lucy Letby”, he said.
