The appeal, filed by attorney Subodh Chandra and attorneys for the Institute for Justice, said that the case is ripe for the Supreme Court to take up because appeals courts across the country have decided similar cases differently.
Cops should not be made to hesitant to make life or death decisions in the field for mere fear of litigation. Immunity should stay. If they violate protocol that is a different matter, and its the protocol that needs to be targeted, not the cops.
