Closing arguments are up next in suspended Jefferson County Circuit Judge Tracie Todd's ethics trial.

that Alabama’s death penalty law was unconstitutional. The COJ ordered Todd, who had been suspended, to return to work Dec. 6 to begin a 90-day period without pay.

COJ member Michael Upchurch, a Mobile attorney, asked Todd if she was trying to conceal the fact that she stayed in Chicago for that time. Todd said she was not. In testimony and in her written answer to the JIC complaint, Todd has said it was illness that delayed her return to Alabama. From Jan. 5 until about March 1, Todd or someone in her family was sick with COVID or suspected COVID-related illness, Todd’s answer to the JIC complaint said.
