NSW Police say the former MP was served with a court attendance notice via his lawyer after an incident with a TV camera operator last month.

Former NSW deputy premier John Barilaro has been charged with assault over an alleged altercation with a TV camera operator in Sydney last month.

Mr Barilaro, who retired from politics in October last year, allegedly assaulted the man outside a bar in Manly on July 23. NSW Police today confirmed officers had served Mr Barilaro's lawyers with a future court attendance notice for alleged assault and malicious damage offences.Vision of the incident was circulated through the media after being posted on social media.

Mr Barilaro was at the time subject to intense scrutiny over his appointment to a public service trade role based in New York.The former leader of the NSW Nationals denied wrongdoing in an interview with Nine radio in the wake of the incident."The way I was confronted outside in the dark, outside of a bar ... a camera shoved in your face, a microphone in your face ... [I] asked him just to walk away ... if that was you, how would you have responded?" Mr Barilaro said.

Giving evidence before a parliamentary inquiry into his trade appointment this month, Mr Barilaro said his life after politics had been a "personal hell".More to come.
