Legal experts say a pharmacist in Saguenay, Que., who refused to prescribe the morning-after pill to a woman was within his rights, but he had an obligation to accommodate her through other means.

Legal experts say the pharmacist had an obligation to make sure the woman received emergency oral contraception.

For instance, Grey says if this pharmacy were the only one in the region where the pill could be obtained, then the pharmacist may be obligated to prescribe it. to receive the morning-after pill when she requested it and in a manner that respected the timeline to ensure a safe medical procedure. Both Eliadis and Grey say companies should screen pharmacists to understand whether they have convictions, religious or otherwise, that would prevent them from fulfilling their legal obligations. Having those conversations with staff would allow pharmacies to plan accordingly, they said.

"It certainly would have been possible for the pharmacist not to express his view and simply to say, 'let me get you another colleague.'"Radio-Canada reported that the Jean Coutu pharmacist acknowledged the incident wasn't the first time he had refused to prescribe emergency oral contraception. She said most of the company's pharmacies already have mechanisms in place that allow clients to receive service from another professional on-site or, when the pharmacist is alone on duty, "as soon as possible at another one of its nearby pharmacies."

Yall laughed when we said the vaccine mandates wouldn't stop at that. You now will suffer the consequences for YOUR decision

This pharmacist took away HER CHOICE by not providing another staff to help. It's a slippery slope

That does not make sense. Legal right not to serve U as customer, but as pharmacist, U have obligation especially when dealing with medicine. A car salesman can refuse U, but can police officer or doctor? There is a big difference. Where’s the boundaries?

Many pharmacists also have issues with MAID drugs some even with birth control pills. And yes they are obliged to let you know where you can get your drugs need fulfilled. This is well known and the pharmacist likely followed this protocol.

the question of religion against lifes is incroyable non sense

Read your bilingual national anthem! The second line “car ton bras sait porter l’épée, il sait porter la croix,” translated as “for your [Canada’s] arm knows how to wield the sword, your arm knows how to carry the cross.”

Wait u need a prescription for plan B in Quebec? We just walk into shoppers and ask the pharmacist here in the west.

If the pharmacist is within his rights, then there is something very wrong with the law: the law must be revised to reflect Que’s secularist values!

Abstinence is the best birth control out there.

If the pharmacist was acting within his legal rights when refusing the legitimate requests of his customer ... we need to argue whether a)the law is up-to-date or b)there needs to be a special legislation for health care in general and pharmacies in particular.

Maybe he shouldn’t be a pharmacist then. I hope he also refuses to fill RX of viagra!!

So religious crackpots can have pharmacies?

Then he should have chosen a career that needs no conscience!

3k a pop for a Covid passport. Get real CBC it is all corruption.

Sounds like the law needs to change

Is it legal for a pharmacist to refuse prescribing Insulin? This is bullshit and nothing more than sanctimonious moralizing on the part of the pharmacist!!! If that is his belief he should change occupations and we need to change this law!!!

Don’t shop anymore at that chain……and def should be fired

BS if you can’t or won’t do your GD job get another one. She does not have to cow tow down to someone else’s belief system. She also has rights & choices. The pharmacist should quit or sell their business. Hope she sues!

I find this confusing. So, one's religious rights/beliefs actually, legally allows a person to be openly discriminatory towards another. So the person treated with discrimination has no rights to protection under the human rights legislation.

There's only one pharmacy in that city? Colour me perplexed.....

Listened to A phone recording with a pharmacist who administered the vaccine to a child without divulging possible side effects. Now, the child is in hospital with myocarditis. (She said they didn't want to scare the child. WTF)

Any person working in the healthcare industry should NEVER EVER be allowed to use their religious edicts and followings to deny medications or healthcare to ANY CITIZEN in CANADA!!!! PERIOD!!

I’m a nurse in preventive health. I prescribed often plan B or other medication. My personal opinion should never interfered. I have to give every option to my patient so they can take the right decision for themself. Should be the same for pharmacist.

Nobody should be forced to do something against their principles. But the request should be satisfied through other means.

Irrelevant. Your personal beliefs do NOT matter. Denying anyone care should lead to immediate loss of license.

Tell him he's in the wrong country.

“Rights”….yes. Professional ethics as a pharmacist….most definitely not. It is not the job of the pharmacist to judge.

👍

Guy needs to find a new line of work.

No excuse fire him.

Fire them and move on! Stop making excuses!

Now let’s get a second opinion from a different legal expert.

They should be fired

Simple, all those who do not agree with the pharmacist, transfer your prescriptions elsewhere. I am sure $ speaks more than convictions.

why is he a pharmacist

I believe the pharmacist is obligated to refer her to someone who can help her. The morning after pill is legally available in Canada

A Quebec Christian pharmacist can express their religion to curtail woman seeking her health rights, but a Muslim woman can’t express her religion wearing a hat in a leadership job. Is this really about conscience? Or is it about who has power?

Pharmacists should keep their personal opinions to themselves.

But it’s not within our rights not to take Covid vaxx or else you get fired, called names by JustinTrudeau and your freedoms and rights taken away.

No! Quebec's rules/laws are clear! JeanCoutu_Pharmacist committed a Provincial crime!

What utter rubbish. Does he also get to refuse service to GLBTQ2+ persons as well? How about people of colour? cdnpoli

Terrible!! All he had to do was pick up the box and pass her the drug. You absolutely do not need a prescription for this medication. So he withheld the drug. Is that legal!!

I guess once again, religions trumps women's health. I know she could go to other pharmacies, but what if it was a very small town and only one pharmacy?

Wrong wrong wrong that pharmacist should lose their licence. Religion has nothing to do with this. Where is this country going if religious belief of any denomination become the law?

That’s such bull shit. He infringed on her rights.

Pharmacists don't prescribe. They sell over the counter meds and fill prescriptions. If he won't do this she should take her business elsewhere. The morning after pill is not illegal in Quebec, am I right?

If I can't get antibiotics for a tooth infection from a pharmacist in Canada without dropping $150 on a dentists appointment for a prescription, what the hell are activists thinking suggesting they should be dispensing abortion pills?

You shouldn’t be in healthcare if your religion prevents you from providing healthcare. MisogynyInHealthcare

There is nothing wrong with refusing to give the pill. It is like there is nothing wrong with doctors refusing to treat the unvaxed. Right? You see the slippery slot. Or there is nothing wrong with not allowing the unvaxed to pursue higher education.?!

if it were another province, everyone would want the guy fired but like usual its Quebexico so special attention has to be made and ya gotta watch what ya say so as to not upset the Quebexicans cause they are entitled and ya gotta be nice to entitled people

There is no case whatsoever for religious rights. You don't base rights on a made-up fairy tale.

So you can't have religious symbols in the work place but your religious believes are more than okay in the workplace to deny a costumer of a product you sell? Make it make sense

I wish pharmacists in Ontario would be allowed to prescribe medications.

Ahh regional Quebec laws and their explicitly religious and racist BS how exciting.

Yeah, it's called plan B FFS and it's been available off the drugstore shelves. Don't bother asking for help these days if you can possibly avoid it ✌️ you can arrive at pretty much all questions by asking your own cellphone

Creampie

Wow nice to see a doctor standing up for the rights of the unborn🙏
