Once the allegations of a group sexual assault after a Hockey Canada function four years ago were revealed in May, some of the reaction has included questions like the above. It’s a perspective that’s alive on social media, in comment sections below news stores, in email inboxes of those who have written about the story. And almost certainly in conversations throughout the country.
“In the ‘80s, it was not against the law to sexually assault the person that you were domestically married to,” Pietsch says. “So, we actually have come quite a distance in terms of what we define or understand as sexual violence, and the key component of consent is really important.” But, generally, what the law says about sexual assault in this country is that consent to a sexual activity is “active and ongoing.”
Pietsch says, when she does things like assault-prevention education at universities, there are often questions about how drunk someone has to be before consent is nullified. But it depends on the person, and there’s no defined number of drinks that would pass a line.
