However, Maumela rejected his notion, citing that he [Thobane] absconded from court without stating his reasons, and therefore the court would not have known if he was still available after Teffo withdrew.On the day this matter was last postponed, Advocate Teffo was alone and there was no pre-warning that Mr Thobane would not be around, and Mr Teffo said nothing about Mr Thobane as an instructing attorney.

Thobane apologised to the court for his absence on several occasions, but indicated that he would be filing a bail application for accused number two, Bongani Ntanzi.Speaking to City Press after the proceedings adjourned, Thobane said the bail application should have been pursued long ago because Ntanzi was employed.He was employed, but lost his job because he was in prison. There is a high possibility of the application being granted as he is supporting up to 10 family members.
