Supreme Court of B.C. Justice Wendy Baker sides with mayor, saying his comments could be justified

At issue was a press release issued by Stewart in January 2021 that stated in part “continuing media reports about the extreme views of Non-Partisan Association board members, including open support for hate groups is deeply troubling … NPA leaders have so far failed to stop hate spreading within their party.”

According to the Supreme Court of B.C. ruling, The Tyee article focused on a photograph from 2017 of an NPA director displaying a “white power” hand signal and wearing a MAGA hat, plus various actions and positions taken by certain NPA directors – while one of The Vancouver Sun articles quoted a former NPA director as stating she had left the party because “it’s just gone so far right.”

That group comprised NPA president David Mawhinney, and past and current directors of the party’s board Christopher Wilson, David Pasin, Phyllis Tang, Angelo Isidorou, Federico Fuoco and Wesley Mussio. Supreme Court of B.C. Justice Wendy Baker found the seven current and former NPA members had not established that any harm they received from Stewart’s statement outweighed the public interest in permitting Stewart’s statement.Article content
