A 2021 law granting embryos and fetuses human rights cannot be used to prosecute abortion doctors for certain crimes like child abuse, a lawyer for Arizona Attorney General Mark Brnovich told a federal judge Friday.

To get answers on at least one aspect of where abortion laws now stand, several abortion rights groups asked a federal judge stop enforcement of last year's law granting rights to the unborn. Lawyers made their case in court Friday morning, but U.S. District Judge Douglas L. Rayes did not say immediately what action he'd take.

The groups previously sought an injunction preventing enforcement, but lost their request after Rayes said in September it was too early to know how judges would interpret the law. At the time, Rayes stalled enforcement ofAbortion advocates made their second request for an injunction "But because I have no way of knowing whether I am breaking the law by providing them care — even life-saving care — or how to ensure that my conduct is in accordance with the law, I have been forced to suspend all abortion services."

But the abortion rights advocates said without a court order in place, providers and potentially women could still face criminal penalties, citing cases in other states and the risk of uneven enforcement of the law by local police and prosecutors.

Rights without competency? I would think that competency law would affect some rights. We're talking about a fetus with very little if any mental capacity. A born human with no mental capacity would have a conservator or guardian and few rights. Out of my belly, fu**ing ideologues & fundamentalists! American society in 2022. It's murder for anyone to harm a human baby in the womb except mom. At least a murder suspect gets a trial, appeals. Human baby gets nothing.
