AfriForum became involved in the case after the National Prosecuting Authority initially did not want to prosecute the accused. After AfriForum’s Private Prosecution Unit wrote a letter to the Director of Public Prosecutions , the NPA decided to prosecute. The defense had earlier brought a Section 174 application after closing the state’s case to acquit the accused based on insufficient evidence. However, this application was rejected by the court because the court found that there was prima facie evidence of assault which had to be answered to.
