Pillay asks Maya to respond to objections lodged against her, which included claims that the SCA was constantly appointing predominantly white people. She denies that this is true and says that she is only aware of three white staff members - one of whom recently left. She has only ever had black secretaries and there is only a white person in the general office. All these people were qualified for the positions"and they are South Africans", she says.

The situation was so dire that she wrote to then Justice Minister Michael Masutha to ask that the law enabling reconsideration be repeated or amended. Seven years later, she has yet to get a response. Justice Minister Ronald Lamola says this issue is"being processed".Commissioner Notyesi asks Maya about the acting appointments at the ConCourt and suggests that there is"not a transparent" process that leads to judges acting at the apex court.

Leeuw then points out that Maya was part of a heads of court meeting that decided that the language of the courts must be English and asks whether it would not have been better for her to translate the Afriforum ruling into all the official languages. That was not what this was about, Maya responds, it was about her specific cultural pride in isiXhosa, which is her language.National Assembly Nosiviwe Mapisa-Nqakula asks Maya about an SCA ruling that she also wrote in isiXhosa.

South Africa's judiciary has never had a woman in its upper echelons. Her appointment as DCJ would address this, she says, and adds that her replacement as SCA president should also be a woman"so we don't regress".Singh asks Maya how she feels about President Ramaphosa appointing male judges at the ConCourt, despite capable female candidates being nominated.Maya says it is up to the judiciary to"clean up" its image - primarily by explaining its decisions.
