Some advocates say Happy the elephant should be legally considered a person, and freed from the Bronx Zoo, where she has spent the last 45 years.

The advocates at the Nonhuman Rights Project say yes: Happy is an autonomous, cognitively complex elephant worthy of the right reserved in law for “a person.” The Bronx Zoo, where Happy resides, says no: Through an attorney, the zoo argues Happy is neither illegally imprisoned nor a person, but a well-cared-for elephant “respected as the magnificent creature she is.”Happy has lived at the Bronx Zoo for 45 years.

“She has an interest in exercising her choices and deciding who she wants to be with, and where to go, and what to do, and what to eat,” project attorney Monica Miller told The Associated Press ahead of the oral arguments. “And the zoo is prohibiting her from making any of those choices herself.”The group said that in 2005, Happy became the first elephant to pass a self-awareness indicator test, repeatedly touching a white “X” on her forehead as she looked into a large mirror.

Happy was born in the wild in Asia in the early 1970s, captured and brought as a 1-year-old to the United States, where she was eventually named for one of the characters from “Snow White and the Seven Dwarfs.” Happy arrived at the Bronx Zoo in 1977 with fellow elephant Grumpy, who was fatally injured in a 2002 confrontation with two other elephants.Happy now lives in an enclosure adjacent to the zoo’s other elephant, Patty.

A wild animal, Happy was captured and enslaved for human entertainment. Let her live out her years in a bigger, better sanctuary. ,🐘🐘🐘

Where is she going that will treat her better than the Bronx Zoo. Pick a more important problem

This is the unhappiest elephant I've ever seen. Elephants are social animals, meaning they need a herd in order to thrive. This elephant just looks sick.

At least send her to a Sanctuary that is not concrete.

After 45 years this is all she knows. She is well taken care of and isn’t being harmed. It would be cruel and frightening to her to force her out of the only home she has ever known.

Forget the angle that the elephant is a person. It’s surely far more intelligent than gobs of “self-aware”s out there. Instead, pressure the zoo to let it live its remaining days in the sanctuary, and start the trend for other senior exhibited animals, as a basic animal right.

It is now clear that the 'New York Highest Court' has nothing better to do or that its member are in serious need of a remedial biology 101 course. Just saying.

There is an elephant sanctuary in Northern California for Happy❤

After 45 years in this setting it would be very traumatizing to her to turn her out. Also, she is probably unskilled in socializing. It might be better to gradually introduce some company for her to see if she bonds.
