The latest twist in the saga of the government's pursuit of Bernard Collaery sees the ACT Supreme Court refuse his application for piles of documents from agencies, including the overseas spy group ASIS.

The latest twist in the saga of the government's pursuit of Bernard Collaery has seen the ACT Supreme Court refuse his application for piles of documents from a number of agencies, including the overseas spy group ASIS.

As part of his defence, Mr Collaery had planned to use the material to question the legality of an alleged spy operation in East Timor during oil and gas treaty negotiations. Mr Collaery had issued four subpoenas to Australia's overseas spy agency ASIS, the department of Prime Minister and Cabinet, the Office of National Intelligence and the Department of Foreign Affairs and Trade.

Mr Collaery maintained he was entitled to contest the legality of the alleged operation, citing legal limits on the functions of ASIS to Australia's national security, foreign relations and national economic wellbeing.
