In its ruling on Thursday, the court also instructed Ntombela to urgently implement a financial recovery plan, and immediate action be taken to address the neglected sewerage infrastructure to stop the pollution of the Vaal and Wilge rivers.
In its unprecedented application that threatened to have far-reaching consequences for dysfunctional municipalities, it sought a go-ahead from the court to run the affairs of the embattled municipality until the government was capable of doing so. "Refuse removal is not taking place and has not been taking place regularly for a period of over two years, as clearly shown in the Mafube local municipality status report dated 26 November 2019," the forum, which was supported by lobby group AfriForum, told the court in the application.
On Thursday, the court found in favour of the applicants and, in its judgment, stated that the municipality and the Free State province were"in breach of the constitutional, legislative and regulatory obligations towards their residents". Commenting after the judgment, Morné Mostert, AfriForum's manager of local government affairs, said the court found that compulsory intervention under section 139 of the Constitution should have already taken place, but that the premier was lax in not fulfilling these obligations. The premier has not acted since 2017 to protect constitutional principles.
