Aloy Ejimakor, a special counsel for the detained leader of the Indigenous People of Biafra , has described the new 'Practice Directions On Trial of Terrorism Cases' as unconstitutional.
It means terrorism trials including the ongoing trial of Nnamdi Kanu and other related ones will be done secretly, even without journalists, except the judge rules otherwise. The first, according to him, is subsection of Section 36 of the Constitution, which states that “The proceedings of a court or the proceedings of any tribunal relating to the matters mentioned in subsection of this section shall be held in public”.
He said the only restrictions the Constitution allow are on a case-by-case basis and it"must be narrowly tailored by the particular court or tribunal before whom the suspect is being tried, not by an omnibus Practice Directions that seeks to envelop every case in one fell swoop".
