The Supreme Court in a split decision of four to three on Friday held that the funding of capital projects for state High Courts, Sharia Court of Appeal and Customary Court of Appeal remains the responsibility of the various state governments.

However, Justices Ejembi Eko, Adamu Jairo and Emmanuel Agim, in their dissenting judgment, agreed with the plaintiffs that the federal government should assume the funding of capital projects of the courts in the various states. Out of the seven Justices who sat on the panel, only Aba-aAji disagreed that the Executive Order 10 by President Muhammadu Buhari be nullified for contradicting the 1999 constitution.
