The Department of Home Affairs loses its bid to delay Monday's court appeal by Novak Djokovic to overturn the cancellation of his visa as details emerge of the world number one tennis player's own legal case amid a separate controversy over him appearing without a mask around the time he had COVID-19.

argued that a COVID-19 infection within the past six months was a medical contraindication — meaning vaccination was not recommended under that circumstance — and that this was based on guidelines set by the Australian Technical Advisory Group on Immunisation.

Mr Djokovic's statement said he had expressed "shock, surprise" and "confusion" when he was held overnight and that he was "pressured" by ABF officials to be interviewed before contacting lawyers and Tennis Australia, due to the time. The drama has caused diplomatic tensions between Serbia and Australia and has become a flashpoint for opponents of vaccine mandates.

Mr Djokovic's December COVID-19 infection also ignited controversy on social media over appearances that he had made at public, indoor events without wearing a mask around the time of his positive PCR test. It is, however, unclear if Mr Djokovic was aware that his test results were positive before appearing at these events.

Why is the Gov stalling? It wants more Love? The Gov of Love! Looks like an open and shut case here. Do we really need more warp zones, alien beacons, stargates or portals to extra dimensions? Probably not,

What are the rules around mask wearing, isolation, etc., where Mr Djokovic was at the time of the test and the photos?

Reckon we might see Novak playing in the AO.

If he tested positive then attended events, I'd say he's not a fit and proper person who does not take safety seriously and should be denied entry on those grounds alone.

Serially infected, vocal anti-vaxxer who organised COVID spreading tournament when regular ones were cancelled for public health safety. Just the role model we want for kids in this nation.

Media bullshit just to fire up all the Karen's....Australia is full of them now

ScottyFailed

medical exemption = above the rules

With a head like his he should wear a mask. Indecent exposure is illegal

Key point 1: the test date was 16 December, not 26 December, which leads to questions about the applicant’s behaviour during the succeeding 3 days (as reported with photographs via social media)

I know why Novax isn’t allowed into Australia!

Really like to stir up your audience, don’t you?

How about a blood test for Djokovic to confirm he actually had Covid around mid December? If not confirmed, a big lie & serious VISA fraud? Serious, entry consequences!

What a farce. Political pissing match at its finest. auspol AusOpen

Come on, courts... The Govt worked so hard to be able to award themselves a new trophy. auspol novakdjokovic

Should say December 16?

This dirty gypsy was spreading covid to little kids knowing he had covid, put the gronk in jail.

It is no double jab then no entry. They knew the rules.

If known positive but actively engaging with people without a mask then perhaps there's a legal breach of some kind? Clearly an ethical breach

Foreign nationals get deported all the time. This antivaxer is taking up a lot of our energy.

Is it December 16 or 26 There are two conflicting dates in your story. Ausopen Djokovic

Both the Vic and Fed govts are about to get their arses handed to them. While Novak was never to blame, he shouldn't have been on the plane to Australia either.

People seem to care more about seeing Djokovic maskless photos than when he sat down with actual genocidal war criminals

jennynorton NO FREEDOM TO AUSTRALIANS LETSGOOOO

December 14 - Novak pictured posing with a BBall player who tested +'ve on the 15th. Between December 16-18 (exact order unclear) Novak attended Junior awards, Panel event, Stamp release, Magazine Photoshoot, and tested positive. Busy week it seems!

Djokovic cares only: himself. Tennis Australia cares only: $$ That is why these two are a good match.

Captain obvious strikes again! We all know how this will end...
