The U.S. Supreme Court heard the arguments on Friday.

The Supreme Court is taking up two major Biden administration efforts to bump up the nation's vaccination rate against COVID-19 at a time of spiking coronavirus cases because of the omicron variant. WASHINGTON, D. C.

“When there’s an emergency, it’s especially important that it be a considered, thoughtful process and legislation is more likely to yield that,” Flowers responded. “Exposure to COVID-19 on the job is the biggest threat to workers in OSHA’s history,” Prelogar said. “The court should reject the argument that the agency is powerless to address that grave danger.”

Missouri Deputy Attorney General Jesus Osete argued the policy will force health care workers to choose between losing their jobs and complying with the vaccine mandate, and that HHS does not have authority to require it. “Those vaccines would have to start immediately,” said NFIB lawyer Scott Keller. “Tracking and record keeping cannot happen overnight.”
