The prosecutor of the International Criminal Court (ICC) has moved to restart an investigation into possible war crimes and crimes against humanity in Afghanistan, according to a statement issued today

investigate alleged crimes committed in Afghanistan since 2003, including the actions of U.S., Afghan and Taliban troops—was deferred in 2020 after a request from the then-Afghan government.

With the Taliban now controlling the country, Khan told the court he believed there was “no longer the prospect of genuine and effective domestic investigations” and asked for permission to resume his offices’ inquiry. If authorized, Khan said his office would prioritize investigating alleged crimes committed by the Taliban and the Islamic State Khorasan, including attacks on civilians, extrajudicial executions, and the persecution of women and girls.

Khan acknowledged this would deprioritize other parts of the investigation, including possible crimes committed by U.S. and Afghan troops, but said it was more appropriate for his team to focus on ongoing crimes to build a more “credible case” in court. This does not mean the ICC is dropping the investigation into alleged U.S. war crimes, Khan said, stressing that “there is no statute of limitations” for these crimes.
