The “hefty” award is a “signal to employers,” said the complainant’s lawyer, Adrienne Smith. “It should be a signal that employers need to be respectful. Correct pronouns for individuals are not optional. Employers are not free to address people by the pronouns they choose to.”

Bar manager Brian Gobelle used she/her pronouns with Nelson and called Nelson gendered nicknames, like “sweetheart, honey and pinky,” according to the decision. Nelson asked him to stop “and he did not.” But Cousineau accepted that Nelson wasn’t told not to speak with Gobelle directly. What happened after that confrontation, during which they discussed pronouns and language, also differed. Nelson said they put their hand on Gobelle’s shoulder in a “gentle touch” and said something “condescending and sarcastic to Mr. Gobelle.”

And Cousineau concluded that the employer was “obligated to respond” and their response “fell short of what was reasonable and appropriate.” By not responding to Gobelle’s misgendering, they “sowed the seeds for the altercation that would lead to Jessie Nelson’s termination.” Cousineau found the employer discriminated against Nelson because it “concluded it would be easier to terminate the employee than to meaningfully address any of these issues.”

We are slowly becoming a society where people will be afraid to talk at all, in fear of offending someone.

So, what is the right language... ? What are they ...? Him or she... ? It's Difficult to say ... ,'hey you', it, in-between, undecided...? What are we to say...? and not offend anyone,

Ok. But what do you call these people without any risk being accused of discrimination? Very confusing.

Eventually, even progressive employers will look for ways to avoid such outcomes. Some will be better at being more sensitive to such employees but my personal opinion is that most will take on the strategy of avoiding such situations ABSOLUTELY.

Guess what group of people is not getting hired very easily from now on.

The moral of the story is don't hire a tranny. Too much hassle and expensive problem.

Considering the paper that is running this story - I’m assuming there’s a lot more to this that a pronoun and a word and they are just sensationalizing to push their point of view.

Not a good trend. You can't force people at workplaces to respect your identity, you compel people to use language that reflects your subjective beliefs about your identity. Also, same commissioner who allowed a male to sue women because they refused to wax his genitals.

This has got to stop. You cannot force other people to live in your demented fantasy world.
