The Justice Department is announcing Thursday that it will file the suit, senior administration officials said. Attorney General Merrick Garland said earlier this week that the department was exploring"all options" in responding to the law.

Does anyone find it stunning that our devoutly Catholic president is not having his justice department filing law suits to protect the most innocent among us, the ones without a voice, the most innocent!
Adding more justices to the court would only be a temporary fix. What needs to be done is getting Kavanaugh and other Trump appointees off of it and replacing them with liberal justices.
However, it would have been better to have a total ban, than a partial ban.///
Congress could simply preempt it via legislation, but I guess Dems have no interest in that.
