Lawyer: Zahid’s 25 money-laundering charges must go away as funds were ‘donations’, not from illegal activities

KUALA LUMPUR, Sept 9 — The money-laundering charges against former deputy prime minister Datuk Seri Ahmad Zahid Hamidi cannot stand as the funds involved were “donations” and not proven to have illegal origins, his lawyer argued in court today.

Teh said the prosecution would have to prove these 25 money laundering charges by proving that Ahmad Zahid as the accused was directly or indirectly engaged with the transactions, and that the transactions involved proceeds of an unlawful activity as well as proving that Ahmad Zahid knew the funds involved were from unlawful activities.

“The accused, in most occasions, did not know or had any nexus with the owners of the cheques,” he argued. Ultimately, Teh was arguing why the prosecution had failed to prove a prima facie case for his client to defend himself against and why such charges should be dismissed. If a prima facie case is proven, the trial would then move on to the defence stage where Ahmad Zahid would be called to enter his defence and he would be able to present his evidence and witnesses in his defence. If the court finds that there is no prima facie case, Ahmad Zahid would be acquitted and released from the charges.
