Palpable tension has gripped the political circles of Senator Stephen Odey and his challenger, Agom Jarigbe over the Cross Rivers North Senatatorial seat

The make or mar final judgment will be handed down by a 3-man panel of the Appellate court headed by Justice Abubakar Datti Yahaya.

Jarigbe currently in the House of Representatives is asking the Appeal Court to unseat the incumbent, Obey to enable him ascend to the upper chamber of the National Assembly Odey on the other hand, is seeking a review of the judgment of the Court of Appeal, Calabar, which had declared his opponent winner of the December 5, 2020 bye-election for Cross River North Senatorial District.A three-member panel of the Court of Appeal, Calabar led by Justice Chioma Nwosu-Iheme, had on July 30, 2021, ordered the sack of Odey in a judgment on an appeal by Chief Joe Agi, SAN and the All Progressives Congress .

The panel while delivering judgments in a consolidated appeal challenging the decision of the National and State House of Assembly Election Petition Tribunal delivered on June 18, 2021, ordered the Independent National Electoral Commission to issue Mr Agom Jarigbe certificate of return which the court held was wrongly withdrawn from him.
